Page 443 The State of Alabama) To the Honorable Bird Fitzgerald, Judge of County of Pike ) Probate for said County Your Petitioner Sarah Cribb, widow of Thomas Cribb, late of said County, deceased, expectfully shows unto your Honor that she and the said deceased were __________ (intermarried?) and that she was the lawful wife of said deceased at the time of his death, that the said deceased departed this life about the __________ day of September ____1858 in the said county seized and possessed of the following land in fee simple to wit.; The South East (1/4) of South West (1/4) West (½) of South West East ½ of North West 1/4, Sec. 29 Town 9, Range 21 lying (next word cut off on copy, I believe the word is situated) and being in the said County of Pike, that the said deceased died intestate leaving the following heirs at law entitled to distribution in his estate to wit., Molsey Fortune, wife of Richard Fortune, Anna Rhodes wife of Samuel Rhodes, Rebecca Whittington, wife of William A. Whittington, and your petitioner, all of whom reside in this County. Also Sarah Faulk wife of Arnold Faulk residents of the State of Florida, William Cribb, a resident of South Carolina & the heirs of Noah Strickland (word cut off but looks like son in law) of one of deceased’s daughters who is supposed to be dead and whose heirs are supposed to reside in North Carolina and whose names are unknown to petitioner. That William A. Gibson is the personal representative of the said deceased. Petitioner further shows unto your honor that in as much as she has never extinguished her rights to Dower in the said deceased’s land, she is according to law entitled to the same, and would therefore ask your Honor to appoint a day for the hearing of this application, and have citations issued to those interested who are not non- residents and have publications made to the non-residents of the time and place of hearing of said petition and have Guardian Ad letium appointment entered to represent the minors. Petitioner prays that an order for the assignment of Dower be granted and such other _____ (may be order) and ______ (unreadable) as petitioner may be entitled to according to law.
