AL Courthouse Written: December 21 1859 Recorded: March 30 1860 pg 323 The State of Alabama / This Indenture, Made the 21st day of December Pike County / in the year of our Lord, One Thousand Eight Hundred and Fifty Nine, Between William A. Gibson, Administrator of all and Singular, the goods and chattels, rights and credits, Which were of Thomas Cribb late of Said County dec’d who died intestate of the one part, and Richard Fortune of the other part. Whereas the said Thomas Cribb by virtue of diverse goods conveyances and assurance in law, duly had and executed, because in his lifetime lawfully origin in fee of, and is the following lands to wit: South East fourth of North West fourth and North East fourth of South West fourth, and South East fourth of South West fourth and South West fourth of South East, (160 Acres) (SE ¼ of NW ¼ & NE ¼ SW ¼ & SE ¼ of SW ¼ & SW ¼ of SE ¼) All is section Twenty Nine (29) Township Nine (T9) & Range Twenty One (R21) with the appurtenances, and being so these of said, died intestate; after when death, to wit at a Probate Court , held at Troy, in, and for the County of Pike and State aforesaid the 29th day of December (One Thousand, Eight Hundred and Fifty eight upon the petition of the Administration aforesaid Stating to the said court that it was necessary for Sale for distribution, and praying the Court to grant an order of Sale of the above described land. It was considered and ordered by the said court, that the premises aforesaid should be sold at public sale, on the 24th day of January 1851, Then next for the purpose aforesaid and a report of the proceedings through be made to the next Probate Court, to be held for the said Court after each sale. In pursuance of which said order, the said William A. Gibson Administrator. As aforesaid, after having given due public and timely notice, of the time and place of sale, did on the day and time therein mention expose the premises aforesaid to sale by public venue or outcry, and sold the sums to Richard Fortune for the sum of Six Hundred and Eighty ($680) Dollars, being the highest bidder and that the best piece bidden for the same; which sale on report thereof made to the Judge of the said Court, on the 27th day of January 1859 following by him confirmed. And it was considered and adjudge by the said Court, that the sums should be and remain firm and stable forever. As by the accords and proceeding of the said Court, notation being thereunto had, will at large appears. Now this introduces Wiluessith, ----- the said William A. Gibson for ---- in consideration of the said sum of Six Hundred and Eighty Dollars to him is land paid by Richard Fortune at, and before the sealing and delivery hereof, the receipt whereof he does herby acknowledges, and thereof acquit and forever discharge the said Richard Fortune , and to him and to his hires, Executors, and Administrators and by the presents, have granted, bargains, sold as confirmed , and these presents in pursuance and by virtue of the said order of the Court, do grant bargain sale and confirm as to the said Richard Fortune, and to his heirs and assignees, all the said land described as follows: SE ¼ of NW ¼ & NE ¼ SW ¼ & SE ¼ of SW ¼ & SW ¼ of SE ¼ of Sec. 29, T9, R21, Together with all and singular, the house, out houses, rights, liabilities, privileges henderments, and appurtenances whatsoever there---- belonging, or in anywise appertaining. And also all the estate, right , title interest, property, claim and demand whatsoever of the said Thomas Gibb, at and immediately begin the time of his decease, in law or equity or otherwise whomsoever given to or out of the same. To have wit to hold the said land, containing 160 acres and with the appurtenance, into the said Richard Fortune his heirs and assignees to there end, proper was and behave of the said Richard Fortune his hairs and assignees ---- the said William A. Gibson administration aforesaid for his ----execution as administrator does now convent, promise and agree, to and with the said Richard Fortune, his heirs and assignees by these present, that 324 of the said William A. Gibson has not hereto fore done or commence any act, matter or thing whatsoever, whereby the promises herby granted or any, said therefore ---- ---- shall or any be charged or encumbered in title, change, estate otherwise, whatsoever. In wetness hereof the said William A. Gibson, administrator as aforesaid, has hereunto set his hand and seal, the day and year above written. Sealed and delivered in the presence of: Wm A. Grissett Benjamin Darman The State of Alabama I Bird Fitzpatrick, Judge of the Court of Probate in said Pike County For the state and County aforesaid hereby certify that George W. Grissett a subscribing witness to the foregoing conveyance known to me appearing before me this day, and being same estate that Wm A. Gibson Admin., the grantor in the conveyance, voluntarily executed the same in his presence, and in the presence of the other subscribing witness, on the day the same bears date, that he attested the same in the presence of the grantor and of the other witness, and that such other witness inscribed his name as a witness in his presence.
