State Of Alabama – Pike County
I, Asberry Fortune, being of sound mind and disposing memory, hereby 
make my last will and testament, revoking any prior documents of a 
testamentary nature, including any and all wills and codicils, and the 
following is my last will:

1. I will that all my just depts. Be paid as soon after my death as 
practically:

2. I do hereby will, devise, bequeath and convey to my children, and to 
my stepchildren here named, Alvoy and Pauline, and to the children of my 
deceased daughter, Lila Mae, everything that I own or my have an 
interest in and (at) the time of my death, including all real estate, 
cash, personal property – everything.

Said children and stepchildren are to take equal shares, and the 
grandchildren of the deceased daughter are to take equally their mothers 
shares; this divided my executor shall pay the respective parts to each;

The real estate, whether correctly described or not, is 39 acres being 
the NE ¼ of the NE ¼ less one acre heretofore sold to my son Woodrow 
Louie, all being in Pike County, in Section 32, Township 8, Range 21;

3. I hereby nominate and appoint my son, Howard Fortune, as executor of 
my estate, without bond and accounting to any Court or person. My 
executor is hereby given absolute authority to sell my property as he 
elects, at private sale, or, at his election, at public sale, under such 
terms as he deems proper, and if he elects to sell at public sale it 
does not have to be through any court, or court procedure, but in such 
manner as he desires; whatever method he sells it at he has full 
authority to execute deeds or deed to the purchaser or purchasers;

IN WITNESS whereof I have set my hand and seal on this the 22 day of 
December, 1958.

presence, and in the presence of each other, and we signed as witnesses 
in his presence, and at his request, in the presence of him and each 
other on the 22 day of December, 1958.

In the Matter of the Estate of Asberry Fortune, Deceased.
Present, Hon.--- Ben Reeves,---- Judge of Probate.
Before me, ----- Ben Reeves ------ Judge of Probate, in and for said 
county, appeared in open Court --- John C. Walters.
Who, having been by me first duly sworn and examined, did depose and say 
on oath, that he is subscribing witness of the instrument of writing now 
shown to him and which purports to be the last will and testament of 
----- Asberry Fortune ----, deceased, late and inhabitant of this 
County, that said --- Asberry Fortune ----signed and executed said 
instrument on the day the same bears date, and declared the same to be – 
his – last will and testament, and that affiant set his signature 
thereto on the day the same bears date as a subscribing witness to the 
same in the presence of said Asberry Fortune, John C. Walters, Dolly 
Griggs --- and that such other witness subscribed his name in the 
presence and in the presence of said – Asberry Fortune, John C. Walters, 
Dolly Griggs.
The said Asberry Fortune was of sound mind and disposing memory, and in 
the opinion of the deponent fully capable of making -- his – will at the 
time the same was so made as aforesaid. Affiant states that said --- 
Asberry Fortune --- was on the day of the said date of said will of the 
full age of twenty-one years and upwards.
