Bird Fitzpatrick Judge of Probate for Pike County Ala. The petition of E. Y. Williams, admis of James Williams dec'd seized and prosessed of the following lands to wit: The W 1/2 of the SW 1/4 and W 1/2 of the NW 1/4 of Sec. 3 and E 1/2 of NE 1/4 of Sec. 4 and NW 1/4 of NW 1/4 of Sec ten all in township 11 of Range 19---- and personal estate counting of slaves, horses, cattle, farming tools----- 2. That by terms of the Last Will & Testament of said dec'd all the estate after the death of his wife says to be divided among his heirs---and that now his wife is dead------ 3. That the lands can not be equally sold (?) divided between said heirs and that said lands ought to be sold & the proceeds of the same distributed this being the only way that an equitable division can be had----- 4. That Julia Lawrence wife of William Lawrence, Elizabeth Barnett wife of Asa Barnett, Mary Owens wife of Robt Owens, E. Y. Williams--- Ann M. Dendy wife of William C. Dendy all of lawful age & resides in Pike Co. ----James Ellis Tucker minor heir of Joann Tucker of said last mentioned County & Perry & Asbury Tucker minor heirs of said Joann Tucker and residents of Montgomery County, and Zackariah Williams of age & a citizan of Conucuch county---and Kissiah Uruqhart wife of Thomas Urquhart--& John A. Williams residents of the state of Florida--- and Wiley W. Williams resident of the State of Georgia and Oliver P. Williams of the State of South Carolina are the heirs of said Testa (?) Therefor your petitioner would pray your Honor to grant all order for the sale of said Realty for the purpose,(?)and in duty bound he will pray the. Williams, William Lawrence, & Isham B. Clayton of the County and State of foresaid and firmly bound unto BIRD FITZPATRICK, Judge of the Court of Probate for said County, and his successors in office, in the penal sum of Twenty thousand Dollars; for which payment well and truly to be made and done, we bind ourselves, our Heirs, Executors, and Administrators, jointly and severally, by these presents----Seal with our seals, and dated this 25th Day of November 1859 THE CONDITION OF THE ABOVE OBLIGATION ISSUE, That whereas the above bound Erwin Y. Williams has been appointed Administrator, of the Estate of James Williams late of said County deceased: Now, if the said Erwin Y. Williams shall well and truly perform all the duties which are or may be by law required of him as such Administrator--then the above obligation to be bond, otherwise, to remain in full force.
